Viewpoint Surveying served notice on behalf of the building owner. The adjoining owner did not respond to either the notice or the 10-day letter. The building owner appointed a surveyor to act as the adjoining owner’s surveyor in line with Section 10(4)(b) of the Party Wall Act. Terry and the adjoining owner’s surveyor were unable to gain access to the property to carry out a Schedule of Condition and subsequently served the award.
