After the building owner served notice, the adjoining owner failed to respond. A 10-day letter was subsequently issued, but no response was received. As a result, Terry from Viewpoint Surveying was appointed as the adjoining owner’s surveyor under Section 10(4)(b) of the Act. Terry and the building owner’s surveyor then drafted and served the award.
